CIRCULAR NO.EPCH/CLS/CERT/99 1st April, 2009 To, All Member Exporters, Subject : CERTIFICATION OF HANDICRAFTS OF BRASS / IRON ITEMS – REG. Dear Member, The Council is pleased to inform that after long persuation and follow up, the Central Board of Excise and Customs has authorized the Council for issuance of Certification for Classification of handicrafts of Brass / Iron. However, the present practice of issuance of certificate by the O/o Development Commissioner (Handicrafts) is continued and the exporters can also avail the services of Regional Offices of the D.C.(H). A copy of the circular No. 56/99-CUS[ F. No. 600/74(Handicrafts)/98-DBK dated August 26, 1999 issued by Ministry of Finance is provided at overleaf for your information. The member exporters whose items have been objected for classification as handicrafts by the O/o Commissioner of Customs may approach the Council along with the following details: 1. Application (Specimen Copy
enclosed) along with Demand Draft / Pay Order of Rs. 200/- + service tax
@10.3% in favour of
the Council ,being the processing charges per invoice. 2. 2 Copies of the invoice / Shipping
bills under dispute by the O/o Commissioner of Customs. 3. 2 Photographs of each item under
dispute / doubt by the O/o Commissioner of Customs. 4. A copy of the speaking order /
objection if any received from the O/o Commissioner of Customs. On the receipt of above documents, the Council would issue necessary certificate as per the provisions and guidelines issued by Department of Revenue, Ministry of Finance, Govt. of India vide their Ref. F. No. 600/74 (Handicrafts)/98-DBK dated 26th August, 1999 as mentioned in the Judgement of the Hon’ble Supreme Court in the case of Commissioner of Central Excise Vs Louis Shoppe and Anr.[1996(83)ELT 13(SC)] for treating a product as “Handicraft”. We also agree to abide by any code of conduct that may be prescribed by the authorities / Council in the matter from time to time.
